What is the Title I occupy the site by?
A Resident's right to occupy the site under the Residential Tenancy Agreement is a leashold right only and not a freehold or other right of an unlimited or perpetual nature with all their rights, responsibilities and obligations according to the Residential Parks Act and Regulations.
What are the current site fees and what do they include?
Sites fees are from $110.00 per week payable fortnightly in advance. This includes garbage disposal and maintenance of all common areas. A resident is responsible for paying their own utilities which includes water, telephone and power.
What other fees and charges apply when I sign a Residential Site Agreement?
Preparation of RSA fee is $15.00.
Boom Gate Card Deposit is $15.00
Are Residents able to obtain rent assistance?
Yes. Residents may be eligible for rent assistance through Centrelink depending on their personal circumstances.
Who is responsible for the maintenance of my home and site?
You are responsible for maitaining the interior and exterior of your home and the site including lawns and gardens.
Are pets allowed?
Residents are permitted to have two caged birds and fish ONLY.
Sorry but we DO NOT allow DOGS, CATS, rabbits etc.
Do I need to insure my home?
It is recommended that you insurer you home and contents. However all residents MUST have at least $5 million public liability insurance and provide a copy to the owners.
Is there parking for caravan, boats or trailers?
A resident must park their caravan, boat or trailer in their carport or find alternative storage off site outside the Village.
Pets
Dogs, cats, rabbits etc are not permitted within the Village. Visitors are not permitted to bring their pets into the Village.
Residents may have two caged birds and fish.
Television
Digital and High Definition television is available in this area.
FOXTEL is available to residents. Please contact the local supplier for information.
Mobile Coverage
There can be difficulty in some areas of the Village obtaining a clear mobile telephone service.
The local suppliers should be able to provide you with information about the services in this area.
Broadband Coverage
You will need to contact the local suppliers for information on the best broadband coverage to suit your requirements and to check the availability to your site.
Village Rules
BAYWAY VILLAGE RULES
The purpose of these rules is to ensure the peace, enjoyment and comfort of all residents and visitors. The Owners and Managers seek your support, co-operation and adherence to these guidelines. Should you have any concerns please do not hesitate to contact the managers during office hours on 4928 2929.The After Hours EMERCENCY contact number is 1300 723 403. This is for emergency use only NOT matters that should be dealt with during office hours or non emergency matters eg. The bore water not working. An emergency is No Town Water, a Power Failure, Inappropriate Behaviour, Excessive noise after 10pm or a Medical Emergency.
1. A Resident is responsible at all times for the behaviour and actions of their visitors.
2. Visitors must adhere to the Village Rules at all times.
3. Residents and their visitors are to obey the reasonable directions and requests by the Village Managers.
4. In the interest of safety, the speed limit of 10kph MUST be observed by all vehicles at all times. Failing to obey the speed limit may result in you being banned from driving within the Village.
5. All vehicles must be parked according to the Village Rules.
(a) (i) A resident cannot park more vehicles on their site than the number stated in their Residential Site Agreement. A vehicle includes, but is not limited to, a motor car, motor cycle, motor home, caravan, trailer and quad bike.
(a) (ii)All vehicles must be parked in the driveway of the resident’s site so that no part of the vehicle is within one metre of the Village road.
(a) (iii) A vehicle may stop outside a home for no longer than five minutes so that passengers or goods, for example shopping, can be either picked up or dropped off. Traffic must not be obstructed. You must park in the driveway if there is room.
(a)(iii) At their discretion, the Managers may grant permission in writing for a resident to park their vehicle on the residents site other than in the driveway.
(b) Residents and Visitors are not permitted to park vehicles on vacant sites.
(c) Visitor’s vehicles must be parked in the designated Visitor Parking Bays or in the driveway of the resident’s home.
(d) Visiting tradesmen may park their vehicle on a Village road as long as it does not cause undue obstruction to other road users. If the driveway is vacant the tradesman must park in the driveway.
6. The Boom Gate will permit only one car at a time. The card issued is for one vehicle. Transfer of the card or tailgating is prohibited. Damage to the control arm will be paid for by the resident concerned.
7. Residents MUST make their own arrangements for allowing tradesmen, deliveries and visitors to enter the Village.
8. No excessive noise after 10pm, this includes television, stereos, air conditioners etc.
9. In the interest of safety and the comfort of other residents, “Happy Hour” and residents gathering are not to be held on Village roads without permission of the Managers.
10. No power tools, mowers or similar are to be used on Sundays, this includes the use of hand tools.
11. Household Garbage is to be placed in suitable garbage bags securely tied and stored in a proper bin. Excessively heavy bags, poor quality bags will not be picked up. Removal will be early on Friday mornings. Recycling will be picked up early on Monday mornings.
12. Green Waste – please leave this outside your home for removal.
13. Removal of Builders waste, old appliance and furniture is to be arranged through Village Management. A fee will apply to cover the cost of dumping.
14. Laundry Hours are 7am to 9 pm. Children under the age of 16 years must have adult supervision. Laundry facilities are not to be used for anything other than laundry. This includes cleaning of fish and washing of dishes. Hot water is not to be taken from the amenities.

17. water aerobic classes. Pool RulesMUST be obeyed at all times; bombing, obscene language & behaviour or abuse of the facilities will not be tolerated and will result in you being banned. The wading pool is for children under 5 years with adult supervision. Children 14 years andunder must have adult supervision who is a resident. Always swim in the company of another responsible person. Poor swimmers must be accompanied by an adult.
18. Tennis Court facilities must be used only for tennis. Proper footwear must be worn at all times.
19. Recreational facilities are at the user’s RISK. The owners accept no responsibility for the injuries or loss sustained whilst using Village facilities. Every step will be taken to minimize the risk factors. Please report any risks or dangers to the Village Managers immediately.
20. Bowling Green facilities are for the use of ALL residents. The correct and proper use is paramount. Proper footwear MUST be worn at all times. Details of games and rollup times are available at the Club House or contact one of the committee or managers. Definitely NO SMOKING on the bowling greens.
21. Children are not to play around amenities, sites, speed humps and boom gate. Activities are to be played only within the Children’s recreation area. The swimming rules apply to this area.
22. BBQ’s facilities are to be left clean after use. No persons under 16 years shall use the facilities.
23. No Open Fires are permitted under any circumstances at any time of the year.
24. Only ONE “FOR SALE” sign is permitted to be displayed on a home that is for sale.
25. Village Notice Boards are not to be used to display home “For Sale” notices. Notices are to be approved by management.
26. No Pets are allowed within the village except for 2 birds in 1 cage and fish. Sites are to be kept clean with seed to be disposed of in garbage not on grassed areas including vacant sites.
27. Bird feeders are not permitted. Do Not feed the wildlife especially the ducks.
28. All building structures including garden sheds are to be approved by the Manager and council. External repainting must be similar to the existing colour scheme and have the manager’s approval.
29. Landscaping is to be approved in writing by the Manager. Grass is to be maintained by the resident. Sites are to be kept clean and tidy according to your Residential Site Agreement.
30. No stakes, poles or digging without written approval. Damages to services must be paid for.
31. Push Bikes must be ridden in an orderly manner and not be ridden through sites. All road rules MUST be obeyed including the wearing of a helmet and the correct use of lights.
31. The use of all Quad Bikes and unregistered Motor/Mini Bikes within BaywayVillage is STRICTLY
PROHIBITED. There will be NO exceptions. There is no implied consent to carry out this activity.
32. All Motor Cars and Motor Cycles used within this Village must be appropriately registered with the
RTA, be roadworthy and driven according to the Village Rules and the normal road rules and regulations.
33. All drivers and riders MUST hold the appropriate licence for the vehicle they are driving or riding.
Unlicensed driving or riding is NOT permitted under any circumstances.
34. The driver or rider of any vehicle within the Village is responsible for its safe use and must obey all the
normal road rules as well as the Village SPEED LIMIT of 10 KPM.
35. The driver or rider IS responsible for any and all damage they cause to their own property and the
property of others. The Village owners and their managers WILL NOT be liable for any damage or loss
caused as a result of any vehicle being ridden or driven within the Village.
36.Unregistered motor cars are not to be parked or stored within the Village without written approval from
the Village manager.
